Terms & Conditions

Welcome to TrueTrail, operated by LMcare B.V., a company registered in the Netherlands ("LMcare", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of the TrueTrail mobile application and related services ("App").

Please read these Terms carefully before using the App.

 

1. Acceptance of Terms

By registering for, accessing, or using the TrueTrail app, you confirm that you are at least 18 years old and have been granted access by LMcare. You agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App.

 

2. Services Provided

TrueTrail offers access to mental health care services including consultations with licensed psychologists, self-monitoring tools (e.g., mood tracking, journaling), and personalized mental health progress tracking. These services are provided for general mental health support and do not constitute emergency or crisis care.

 

3. Eligibility and Registration

To use TrueTrail, you must:

  • Be 18 years of age or older.
  • Be granted access by LMcare following initial approval.
  • Provide accurate, complete registration information.
  • Keep your login credentials secure and confidential.

 

4. Use of Professional Services

Our licensed psychologists provide mental health consultations via the App. By using these services, you acknowledge that:

  • Appointments must be scheduled via the App.
  • Your information will be securely shared with the assigned professional.
  • Services are not suitable for emergencies (see Section 10).

 

5. User Data and Privacy

We collect and process the following personal data:

  • Name, date of birth, email, sex
  • Mood logs, face scan data (if applicable), journal entries, mental health progress

Your data is processed in compliance with the General Data Protection Regulation (GDPR) and our Privacy Policy. We use encryption and other appropriate safeguards to protect your information.

 

 

6. User Conduct

You agree not to:

  • Use the App for unlawful or harmful purposes.
  • Impersonate others or provide false information.
  • Attempt to gain unauthorized access to other user data or systems.

LMcare reserves the right to suspend or terminate accounts for violations of these Terms.

 

7. Intellectual Property

All content and materials in the App, including software, text, graphics, logos, and brand elements, are the property of LMcare or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, or reproduce any part of the App without prior written consent.

 

8. Medical Disclaimer

TrueTrail provides access to mental health professionals, but:

  • It is not a substitute for emergency care, diagnosis, or treatment for severe psychiatric conditions.
  • In case of immediate danger to yourself or others, call emergency services or seek help through a local crisis center.

 

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • LMcare shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
  • We do not guarantee uninterrupted availability or error-free operation of the App.

Your use of the App is at your own risk.

 

10. Modifications to the Terms

We may update these Terms occasionally. You will be notified of significant changes through the App or via email. Continued use after changes are made constitutes your acceptance of the revised Terms.

 

11. Termination

We may terminate or suspend your account at our discretion for breach of these Terms or misuse of the services. You may also discontinue use of the App at any time.

 

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Dutch courts.
